I never said that they shouldn't be taken seriously, you're reading into what I said. However I just disagree that both of those statements are the same. One is a lie by omission, the other is not.

Where? Most places don't have very up to date definitions on the definition of rape and up until recently in many places you had to have a penis to be guilty of rape. I would argue based on the type of crime that it is, it would more fall under sexual assault rather than rape.
I'd still be interested in those places so I can read how they do their legislation.

It's literally not. Every dictionary I can find the definition for puts the definition of removal of a condom secretly which this is not the case, tampering with a condom reduces it's effectiveness but isn't removing it. The definition also clearly puts it as sexual assault and not rape.
I'm not justifying the practice, but I don't think spreading wrong and incorrect information is really adding much to the conversation.

Dude really think about the implications of someone who won't tell you things, that will effect you, just because they are afraid of your reaction(which is they are afraid you will leave or not even start with them)..
