Not a lawyer, but I think it’s highly unlikely that the OP would be prosecuted.
Although the burglar took a bit of a beating he was presumably able to get up & walk away as OP didn’t need to call an ambulance & didn’t say anything about him still being there.
The cases where people have been prosecuted for going to far have been pretty egregious. Tony Martin shot someone in the back when they were running away. In the other examples, it’s most likely that they continued to use violence after the burglar was no longer a threat.
A better example in this case would be to look at Duncan Ferguson the football / soccer player.
(For those in America who haven’t heard of him, he’s known as the toughest guy to ever play soccer in the UK. Imagine breaking into a home & being unlucky enough to randomly pick William “The Refrigerator” Perry’s house. Ferguson isn’t as heavy as him, but more than makes up for it with pure temper & is still the only soccer player in history to serve jail time for assault long someone on the field).
He has disturbed burglars in his house a couple of times, kicked the living shit out of them both times & was not charged on either occasion.
As I say, I’m not a lawyer but the situation seems far more similar to that, than any case I have seen where the homeowner has ended up being charged.
You don't. Just tell them you are going instead of asking. You're an adult and don't need their permission.
