You also can’t prove she voluntarily had sex either. The point is moot. She shouldn’t have gotten so drunk she doesn’t remember anything . She can’t fix this she broke trust and I’m with the bf if it was me I would be done too.
Call the police to do a wellness check on him and then block him everywhere. Everytime you talk to him you are just dragging this out. He obviously can't just be friends with you. And be carefully about him becoming a stalker. He sounds like he has mental health issues that you are not qualified to deal with.
If he's asking for an open relationship, he probably already has someone in mind. And even if you say no, there's a good chance he'll just cheat anyway. I'm sorry you're going through this!
